Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of the DOMINO REAL mobile app and the dominoreal.com website (the “Service”), provided by Domino R. Enterprise (“DOMINO REAL”, “we”), with an office in Houston, Texas, United States. Read them carefully together with the Privacy Policy. The Spanish version is the main version.

1. Acceptance

By creating an account, ticking the acceptance box or using the Service you accept these Terms and the Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

• You must be at least 18 years old and have the legal capacity to accept these Terms.
• You must not be barred from using the Service by the laws of your country, nor have been suspended or banned from the Service before.
• You are responsible for complying with the laws that apply to you where you use the Service.

3. Your account

• You must give us true information and keep it up to date (email, username and phone).
• You may have only one account. Accounts are personal and non-transferable: you may not sell, lend or share them.
• You must keep your password and verification codes safe; we recommend turning on two-step verification. You are responsible for the activity on your account and must tell us at once at [email protected] if you suspect unauthorized use.
• Your username and profile picture must not be offensive or misleading, nor impersonate another person or brand.

4. One session per account

Each account may have only one active session in the app. To sign in on another device you must prove the account is yours with a code sent to your email or with your two-step verification code; doing so signs out the other device.

5. Virtual chips

• The Service uses virtual chips: game chips, used to join and play at tables, and administrative chips, used by clubs, super agents and agents to manage their organization.
• Chips are a limited, revocable, non-transferable license to use inside the Service. They are not money, you do not own them, they earn no interest, and DOMINO REAL does not sell them, buy them or exchange them for money, goods or services.
• Chips are granted and withdrawn by the clubs inside the Service. Any arrangement between users, clubs or agents outside the Service is the sole responsibility of the people who make it; DOMINO REAL is not a party to it.
• The Service offers no real-money features. If they are enabled in the future, they will only be offered where legally authorized and under additional terms. Using the Service for illegal gambling is forbidden.
• We may correct chip balances and movements caused by technical errors, fraud or breaches of these Terms. Chips give no right to any compensation if the account is closed or suspended.

6. Tables and game rules

• Each table shows its conditions: domino type, minimum entry, pass cost or Buy-In, and the charge applied. By sitting down you accept those conditions.
• Entries, passes, pots and charges are computed automatically on the server according to the rules published in the app. Charges are split among the club hierarchy according to the configured contracts.
• Turns have a time limit. If your turn runs out a pass is applied, as for any player.
• Idleness: if you are online and let your turn run out, the pass is applied and you are marked idle; your next turn is shorter and, if it also runs out, you are removed from the table without being charged another pass.
• Disconnection: if you are offline when your turn runs out, the pass is applied and you are removed from the table.
• When you are removed from a table for idleness or disconnection, every chip you have at the table is returned to you at once; you lose nothing beyond what was already played.
• Minimum chips at the table: to sit you need at least the chips of one worst-case game (the pot entry, every possible pass and a capicúa) plus a 40 % margin. To stay seated you need at least those of one worst-case game, so you can always pay the passes made to you. If you end a game below that limit you are removed from the table and your chips are returned; you can top up before to stay.
• The server’s records are the reference for settling any dispute about a game.

7. Clubs, unions and roles

• Clubs are created with our approval. Their owner and managers run the club: they approve members, assign roles (super agent, agent or player), contracts and permissions, and manage the club’s chips.
• Super agents and agents only see and manage the members they referred. Contract percentages are set by the club or by whoever is above in the hierarchy.
• Unions group clubs and share tables; the union’s owner club manages its tables.
• Club and union administrators must use their functions in good faith, comply with the law and these Terms, and are responsible for the arrangements they make with their members. We may step in, correct or suspend when we detect abuse.

8. Fair play

It is forbidden to:

• Collude with other players: share information about tiles, coordinate moves or lose on purpose to transfer chips.
• Have or use more than one account, or use someone else’s account.
• Fake your device’s location or in any way get around the rule that prevents playing at the same table within 1 metre of another player.
• Use bots, scripts, automation software, modified clients or any outside help to play.
• Exploit bugs in the Service instead of reporting them, or try to access systems, accounts or data without authorization.
• Harass, threaten or insult other people, impersonate anyone or post illegal or offensive content.
• Copy, decompile or reverse engineer the Service, or use it for unauthorized commercial purposes.

9. Suspension and termination

We may investigate, suspend or close accounts, remove players from tables or clubs, void games and correct chip movements when these Terms are breached, other users are at risk or the law requires it. You can delete your account at any time from Profile › Delete account.

10. User content

You are responsible for the images, names and other content you upload (avatar, club logo and name). You declare that you have the right to use them and grant us a free, worldwide license to host and display them inside the Service while they are published. We may remove content that breaches these Terms.

11. Intellectual property

The Service, its software, design, trademarks and content belong to DOMINO REAL or its licensors. We grant you a personal, limited, revocable, non-exclusive license to use the app under these Terms. You acquire no other right.

12. Availability, maintenance and updates

We may carry out scheduled maintenance, during which the Service is unavailable, and require you to update the app to a minimum version to keep using it. We may change, suspend or discontinue features at any time. We do not guarantee that the Service will always be available or free of errors.

13. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim all express or implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

14. Limitation of liability

To the extent permitted by law, DOMINO REAL will not be liable for indirect, incidental, special or consequential damages, nor for the loss of data, virtual chips, profits or goodwill. Our total liability for any claim related to the Service will not exceed one hundred US dollars (US$100). Nothing in these Terms limits rights that the law does not allow to be excluded.

15. Indemnification

You agree to indemnify and hold DOMINO REAL harmless from third-party claims arising from your breach of these Terms, the law or third-party rights, including the arrangements you make with other users, clubs or agents.

16. Governing law and disputes

These Terms are governed by the laws of the State of Texas and the applicable federal laws of the United States, without regard to their conflict-of-laws rules. Before bringing any claim, write to us at [email protected] to try to resolve it amicably for at least 30 days. Disputes that are not resolved will be submitted to the state or federal courts of Harris County, Texas, without prejudice to the non-waivable rights granted to you by the law of your country of residence.

17. Changes to these Terms

We may update these Terms. We will publish the new version with its effective date and ask you to accept it in the app; if you do not accept it, you will not be able to keep using the Service.

18. General provisions

These Terms and the Privacy Policy are the entire agreement between you and DOMINO REAL about the Service. If any clause is invalid, the others remain in force. Not exercising a right does not waive it. We may assign these Terms in a corporate transaction; you may not assign them. The Spanish version prevails over translations.
